Website General Conditions of Use (GCU)

 

1. Site features

1.1 The www.wethetalent.com website (hereinafter referred to as the “Website”) and its linguistic variations constitute the whole and exclusively property of:

TALENTSOFT, as editor of the Website, grants any person who visits the Website (hereinafter referred to as the “User”) a private, non-collective, and non-exclusive right to use said content.

1.2 All data of any nature, including text, graphs, logos, icons, images, audio and video clips, trademarks, software, and features of the TALENTSOFT website, appearing on the Website and on its various versions, are protected by copyright, trademark, and all other intellectual property law, and belong to TALENTSOFT as a company, or to authorised third parties.

1.3 In browsing the Website, you agree not to reproduce, summarise, edit, alter, or redistribute, without our prior authorisation, any text, title, application, software, logo, image, video, trademark, information or illustration, for any purpose other than strictly personal use. Any other form of representation (e.g. for professional, commercial or redistribution purposes) without prior express and written authorisation is strictly forbidden.

1.4 You also agree not to extract all or part of the Website for content import and storage purposes.

1.5 All website hyperlink creation towards the Website shall be subject to prior express authorisation by TALENTSOFT. This authorisation may be withdrawn at any time by TALENTSOFT without having to provide any justification.

1.6 Third-party websites are not under the control of TALENTSOFT, who is in no way responsible for the content of these websites, the hyperlinks they contain, or the changes or updates made to the websites. TALENTSOFT provides these hyperlinks for convenience or information purposes, and the inclusion of any link does not imply prior approval of the website by TALENTSOFT. 2. Access and Availability:

2.1 By browsing the Website, the User agrees to comply with these GCU.

2.2 Access to the Website is free and is provided on a continuous and permanent basis, except in case of force majeure or events beyond the control of TALENTSOFT, and subject to possible technical failures and interventions, maintenance, and necessary updates required to ensure the proper functioning of the Website.

2.3 THE WEBSITE IS ACCESSIBLE “IN ITS CURRENT STATE”; TALENTSOFT CANNOT BE HELD RESPONSIBLE FOR INDIRECT DAMAGES THAT MAY OCCUR FROM USING THE INTERFACE, INCLUDING LOSS OF BENEFITS, PROFIT, IMAGE, CLIENTELE, BUSINESS, REPUTATION OR EXPECTED GAIN, TIME SPENT BY EMPLOYEES OR SERVICE PROVIDERS OR LOSS OF OPPORTUNITY.

2.4 You are solely responsible for the computer equipment used for accessing the Website. You are responsible for taking all necessary measures to protect this equipment, including from any form of contamination by viruses, malware, worms, logical bombs, Trojan horses, or any other element of code, file, program, script and/or malicious or harmful agent.

2.5 You may view and post comments on the Website (hereinafter referred to as “Comments”). For each published Comment, you will be asked to provide your name or username, as well as an email address. This information constitutes personal data. For further information on TALENTSOFT’s processing of your personal data, please consult our Confidentiality Policy.

2.6 The User may submit an article (hereinafter referred to as “Articles”) to TALENTSOFT for it to be published on the Website. The users of the Website agree to submit useful Articles, related to subjects addressed by the Website. For each Article proposal submitted to TALENTSOFT, you will be asked to provide your first name, last name, email address, and a short professional bio. You may also specify, entirely at your discretion, your job title, the name of the company you work for, and, where applicable, your social media contact information. This information constitutes personal data. For further information on TALENTSOFT’s processing of your personal data, please consult our Confidentiality Policy.

2.7 Parents and any person exercising parental authority are reminded that it is their responsibility to ensure the proper use of the Website and its content by any minor under their responsibility. Minors under the age of 13 must not use the Website without the authorisation and permanent supervision of their parents or other legal guardian.

 

3. Content of Comments and Articles

3.1 You are responsible for the Comments and content thereof, as you published them on the Website. You agree not to publish Comments or submit Articles for publication that are offensive, defamatory, racist, xenophobic, pornographic, of child pornographic nature, inciting explicitly or implicitly to make unlawful remarks, and more generally, any content contrary to any applicable law, public order and accepted principles of morality.

3.2 Comments and Articles shall not contain business proposals, advertisements, or special offers for any product or service, without the prior and express agreement of TALENTSOFT.

3.3 You agree not to publish any Comments or submit any Articles for publication which may contain personal data or which may violate privacy, image rights, or the intellectual property rights of third parties or natural or legal persons. TALENTSOFT shall not be liable for any violation of the image or intellectual property rights of such third parties. You agree to compensate TALENTSOFT for all costs, charges, and expenses that TALENTSOFT would incur as a result of this violation.

3.4 In accordance with French Act No. 2004-575 of 21 June 2004 regarding Confidence in the Digital Economy (hereinafter referred to as “LCEN”), TALENTSOFT does not perform any prior verification of Comments. TALENTSOFT reserves the right, at its sole discretion and without notice, to delete all the Comments which violate current legislation or these GCU. Users of the Website are encouraged to notify TALENTSOFT of any content that is unlawful or contrary to the GCU. TALENTSOFT agrees and undertakes, promptly upon receipt of such notification, to verify said content and to withdraw it, where applicable. TALENTSOFT cannot be presumed to have had knowledge of the unlawfulness of the content or of the failure of said content to comply with these GCU.

 3.6 In accordance with the LCEN and French Act No. 82-652 of 29 July 1982 on Audiovisual Communication, TALENTSOFT performs a prior verification of Articles and their content. TALENTSOFT reserves the right, at its sole discretion and without prior notice, to reject or publish Articles submitted by the User.

3.7 In publishing a Comment or Article on the Website, these GCU imply that you expressly waive any monetary claim with regard to the creation of Comments and Article, and content and dissemination thereof.

 

4. Website Content

4.1 All the information available on the Website relating to TALENTSOFT services, as made available by TALENTSOFT, is based on the technical characteristics of these services at the time they were made available online or updated. The information contained on the Website is of a general and descriptive nature. It cannot be considered as having contractual value, nor does it constitute a firm offer from TALENTSOFT.

4.2 TALENTSOFT shall publish and maintain the Comments and Articles on the Website, provided that they comply with applicable legislation and these GCU.

 

 5. Personal Data

On a general basis, you can access the Website without having to provide any personal data. However, certain Website features require that you provide us with certain personal data.

The conditions under which TALENTSOFT processes your personal data, in accordance with the provisions set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, applicable from 25 May 2018, and French Data Protection Act of 6 January 1978, as amended, are defined in our Confidentiality Policy.

7.2 The  www.wethetalent.com Website, linguistic variations, and structure, may be subject to modifications and developments without any form of notification. TALENTSOFT reserves the right to unilaterally modify these GCU, without prejudice to your rights. We recommend that you consult our GCU, Confidentiality Policy, and Cookies Policy on a regular basis.

7.3 TALENTSOFT reserves the right to unilaterally modify the terms of these GCU. The new clauses will govern all future relations between Talentsoft and the users of the Website, and only the latest online version will be applicable in this regard.

7.4 In the case where one of the provisions contained in these conditions is deemed to be void as a result of a current or future legal or regulatory provision, or as a result of a legal decision that has the force of res judicata and is issued by a competent jurisdiction or body, this provision of the GCU shall be considered to be void but all other provisions of these GCU remain enforceable between TALENTSOFT and the User.

7.5 The Website, including these GCU, the Confidentiality Policy, and the Cookies Policy, are subject to French law, both in substance and form.

7.6 These GCU were originally drawn up in French. In case of differences or contradictions between linguistic versions, only the French version of the GCU shall apply.
